Sale of Alcoholic Beverages You must 21 years or older to purchase wine from Napa Valley Wine & Cigar. By placing an order for wine, the buyer swears and affirms they are 21 years of age or older. The use of this website to purchase wine by anybody under the age limits specified herein, constitutes fraud. We prosecute internet fraud. Title and Ownership Title to and ownership of, all wine passes from Napa Valley Wine & Cigar, (napavalleywineandcigar.com), to the purchaser in the state of California and the purchaser takes all responsibility for the shipping of it from California to the purchaser's home state. By arranging for transportation of the wine, Napa Valley Wine & Cigar is providing a service to, and acting on behalf of the purchaser. By utilizing this service from Napa Valley Wine and Cigar, the purchaser is representing that he/she is acting in a manner compliant with his/her local and state laws regarding the purchase, transportation and delivery of wine. The purchaser represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered and once again swears and affirms he/she is 21 years of age or older. Shipping
During winter and summer months, we cannot guarantee that the wine will not suffer from exposure to extreme cold or extreme heat during shipping. To minimize this risk we may ask that you utilize second day or overnight shipping at an increased cost, to protect your investment. While we generally watch the weather for the continental United States, it is incumbent upon the purchaser to chose the appropriate means of shipping to avoid exposure to heat/cold in their specific location. Specific countries require wine be shipped to a designated receiver or importer for the levying of duties or taxes.
Napa Valley Wine & Cigar cannot be responsible for wine damaged by a shipper or inappropriate storage/handling on the part of the buyer, although we will make a reasonable effort to resolve any disputes. We reserve the right to refuse sales if we deem it to be inappropriate and/or unsafe.  Napa Valley Wine & Cigar cannot ship to PO, APO, or FPO box offices. We do not ship to AL, DE, KY, MA, ME, NH, PA, TN, TX or UT.
Orders to Alaska or Hawaii must be shipped 2nd Day Air or Overnight
Incorrect, insufficient, or a change of address will incur a $10.00 surcharge.
We reserve the right to charge return shipping for refused or undelivered packages.

Returns.
Because of the fees charged by your credit card company when we charge and subsequently credit your card, we will enforce the collection of our restocking fee, if your card has already been charged. We charge your card when your order is pulled from inventory, packed, and prepared for shipping. If we haven't charged your credit card, you may cancel the order without being subject to our restocking fee. If we have already charged your card, the cancelled processed credit card order for wines in-stock, shipped or not, are subject to a 5% restocking fee. Cancelled processed credit card "special" orders are also subject to a 5% restocking fee. Please check your order receipt carefully to make sure you ordered the correct wine. We will not be responsible for any incorrect orders placed by you, the customer. Any incorrect orders that are processed and shipped will be subject to a 5% restocking fee, as well as shipping charges back to us if you want to return the item (s).
